Village Board Meeting - May 2, 2005Minutes of the Regular Meeting of the Board of Trustees of the Village/Town of Mt. Kisco held on Monday, May 2, 2005 at 7:30p.m. in the Frank J. DiMicco Board Room, Village Hall, 104 Main Street, Mount Kisco, New York.

Absent: Trustee Peter DiChiara
Also Present: William Williams, Village Manager/Clerk James Palmer, Assistant Village Manager Whitney Singleton, Village Attorney
Mayor Cindrich opened the meeting with the Pledge of Allegiance and asked everyone to please reflect on why we are here and asked for guidance in the decisions that we make this evening will benefit the entire community.
1) Communications - A. Resolution Approving Request from the American Legion Auxiliary Motion made by Trustee Griffin, Jr. and seconded by Trustee Marcus approving the request from the American Legion Auxiliary to offer Memorial Poppies in the Village during May 2005, all in favor. B. Letter from Lisa Marino dated April 11, 2005 resigning from the Leonard Park Committee.
C. Letter from Kim Terlizzi dated April 27, 2005 expressing interest in serving on the Recreation Commission.
2) Petitions - None.
3) Board, Committee and Commission Reports - None.
4) Village Manager's Reports - A. Level of Byram Lake Village Manager, Bill Williams, advised that the overall level at Byram Lake continues to be high at 105% capacity. The daily average for the month was 1,319,100 gallons per day.
B. Resolution Scheduling an Executive Session Motion made by Mayor Cindrich and seconded by Trustee Griffin, Jr. scheduling an Executive Session following the regular meeting for the purpose of discussing real-estate matters regarding the Swiss Benevolent Property and the Old Post Office Building, all in favor. C. Village Manager, Bill Williams, advised that all Village offices will be closed on Monday, May 9, 2005 for Records Management Day.
D. Brian Parker, member or the Byram Lake Committee stated that the draw of Byram Lake is within the bounds of the scope of the Byram Lake Committee's work. Mr. Parker said that more analysis is being done and hoped that, before the Village commits to letting some of our water go elsewhere, they consult the Committee first. Mayor Cindrich said that he is concerned about the discrepancy in flow metering and that we may have a 30% deviation of accuracy. Mayor Cindrich said that this is not as much of an issue at the present time since we are in a high water table period. Mayor Cindrich said that he is concerned about the information that is fed to the Planning Board on how much water the Byram Lake will yield and that we don't obligate ourselves to a point where we cannot produce enough water to satisfy the people of Mount Kisco.
5) Board Reports - Mayor Cindrich said that there are a lot of rhetorical statements going around about the Trump Project at Seven Springs. Mayor Cindrich said that he has been speaking with North Castle and feels that Jack Lombardi, Supervisor of North Castle, has been right on target by asking Donald Trump what his intentions are for this property. Mayor Cindrich stated that we have on the agenda this evening for consideration a Greenway Community Grant Program that would help the North Castle/Bedford communities acquire Seven Springs in the event there is "a willing seller and a willing buyer and that the willing buyer has the funds". Mayor Cindrich said that if DEP, DEC, and EPA want to make funds available to purchase Seven Springs from Donald Trump, this Board would support that venture. Mayor Cindrich said that when he first became Mayor he met with Mr. Trump and at that time Mr. Trump said that he would consider not building a golf course if he could get support for his housing development. Mayor Cindrich said that the housing proposal was discussed with all of our Byram Lake Committee, Citizens for Byram Lake and all of our experts in the environmental area and the consensus was is that the housing development would have a significantly lower impact on the lake as would the golf course. Mayor Cindrich stated that if the initiative is to buy the property and preserve it in perpetuity as green space the Board will support it as long as the funding is there. Mayor Cindrich said that if the funding is not there, he will support the housing proposal providing it protects the areas that the Village has deemed in need of being protected. Trustee Grunthal said that he feels the same way as the Mayor that he would prefer to see a housing development rather than a golf course if we cannot keep it as open space. Trustee Griffin, Jr. concurred with the Mayor and said that it is regretful that Westchester County doesn't see the value of this green space and get involved with the funding to keep it green space or a County Park. Trustee Markus said that he agreed that we are all for open space and would like to be able to keep as much open space around Byram Lake as possible. Mayor Cindrich said it is a significant amount of money and has spoken with the County Executive and our State Leaders, and they are concerned of where the funding would come from. Mayor Cindrich said Mr. Trump has informed the North Castle Board last week, that the Trump organization was not a willing seller. Mayor Cindrich said that North Castle is vigorously pursuing this and thanked Trustee Markus, Suzanne Grant, Joyce Wall and others for attending the meetings in North Castle.
6) Old Business A. Resolution Approving IMA for Storm water Management Motion made by Trustee Markus and seconded by Trustee Grunthal authorizing the Village Manager to sign the IMA for Storm water Management Grants from the New York State Department of Conservation, all in favor. B. Resolution Approving Thru Way Plumbing & Heating, Inc. Motion made by Trustee Griffin, Jr. and seconded by Mayor Cindrich authorizing the Village Manager to sign the Agreement with Thru Way Plumbing & Heating, Inc. for Contract Services , all in favor. 7) New Business A. Greenway Communities Grant Program-Guidelines & Application Village Manager, Bill Williams, said that before we can proceed with the grant application, the Village will have to pass a resolution that includes the Greenway Criteria. Mayor Cindrich asked that this be forward to the Byram Lake Committee, Conservation Advisory Council and the Citizens for Byram Lake for their review before we proceed with the application.
B. C. Resolution Scheduling a Public Hearing Re: Community Block Grant Motion made by Mayor Cindrich and seconded by Trustee Griffin, Jr. scheduling a Public Hearing for Monday, May 9, 2005 at 7:30pm with respect to a Community Development Block Grant, all in favor. D. Resolution Approving Westchester Cooperation Agreements Village Manager, Bill Williams, explained that since the inception of the Urban County Community Development Consortium, Towns and Villages who will be receiving Urban Block Grants must sign an agreement with the County of Westchester for the purposes of undertaking the Community Development Program. Mr. Williams said that this is a pledge from the Community that if they accept the grant communities will follow the guidelines of the program and the Federal requirements that go with it.
Motion made by Trustee Markus and seconded by Mayor Cindrich authorizing the Village Manager to sign the Westchester County Cooperation Agreement for FY2006 and beyond, all in favor.
