Village Board Minutes - October 10, 2006Minutes of the Public Hearing and Regular Meeting of the Board of Trustees of the Village/Town of Mt. Kisco held on Tuesday, October 10, 2006 at 7:30pm in the Frank J. DiMicco Board Room, Village Hall, 104 Main Street, Mount Kisco, New York.

Mayor Cindrich opened the meeting with the Pledge of Allegiance and asked everyone to pleased reflect on why we are here and asked for guidance in the decisions that we make this evening will benefit all the people of Mount Kisco. Mayor Cindrich asked to keep in our prayers the leaders in Washington who are sending our young men into peril and that they make the right decisions.
Liz Dieter introduced the Fox Center Entertainers. Ms. Dieter advised that Recreation Leaders throughout the County ran a Golden Idol Competition among the various Senior Centers in the County on September 15, 2006. Ms. Dieter stated that she is pleased to announce that the Fox Center Entertainers competed and won for Best Vocal Performance. The Fox Center Entertainers sang their award wining song "Your Just in Love" , musical director Dorothy Schulman and accompanist Pat Reilly.
Continuation of a Public Hearing on a Petition by Caf La China, appealing the decision by the Village Manager regarding their Amusement License Denial.
Mayor Cindrich read a letter received by Stanley Johnson, 42 Smith Avenue, Mount Kisco addressed to the Village Manager dated October 10, 2006 and a letter received from Santo Asaro, 115 Gregory Avenue, Mount Kisco, New York dated October 10, 2006. Mayor Cindrich said that the Village Manager denied the Cabaret License based on the fact that the structure is located less than 500 feet from a school. Mayor Cindrich advised that a 500 foot separation is required by law. There being no further comments to come before the Board a motion to close the Public Hearing was made by Trustee Griffin, Jr. and seconded by Trustee Grunthal, motion was moved unanimously.
State Assemblyman Adam Bradley addressed the Board and community. Mr. Bradley said that he and Senator Liebell met with Mayor Cindrich in an effort to obtain money for Mount Kisco's Library construction project. Assemblyman Bradley advised that he is pleased to report that he and Senator Liebell will be providing $100,000 ($50,000 each) toward this project.
1) Communications: A. Resolution Approving the Request For A Block Party Motion made by Trustee Grunthal and seconded by Trustee DiChiara approving the request from Beth Romski, 8 Brentwood Court, Mount Kisco to hold a Block Party on Sunday, October 22, 2006 from 2:00pm to 4:00pm and to include a special garbage pick-up on Monday morning, all in favor. B. Resolution Approving the Request for a Block Party Motion made by Trustee DiChiara and seconded by Trustee Grunthal approving the request from the Captain Merritts Hill Neighborhood Association to hold a Block Party on Willets Road, Saturday, October 14, 2006 from 3:00pm to 8:00pm and to include a special garbage pick-up on Monday morning, all in favor. 4) Village Manager's Reports - A. Letter of Byram Lake Village Manager James Palmer advised that the level of Byram Lake at 2:00pm this afternoon was at 95.5% of capacity. Mr. Palmer advised that the daily average pumping from the Lake was 1.56 million gallons per day and daily average pumping from the Saw Mill Pump Station was 1.49 million gallons per day.
B. National Incident Management System Training Update Village Manager, James Palmer advised that the Village of Mount Kisco along with other municipalities is under a Presidential directive through the Department of Homeland Security to ensure that all communities administrator a National Incident Management System. Mr. Palmer advised that as part of this National Incident Management System Village staff is being trained to ensure that there will be a coordinated response to emergencies. Mr. Palmed advised that employees need to take a variety of courses to understand the proper structure to respond to emergencies within Mount Kisco.
C. Beautification Committee Village Manager, James Palmer, advised that the Beautification Committee is pleased to announce that the Decade of Greenway Award was given to the United Methodist Church and the Flower Basket Award was given to Calico Corners.
D. Westchester County Clerk's Mobil Office Village Manager, James Palmer, announced that the Westchester County Clerk's Mobil Office will be in Mount Kisco on Tuesday, October 24, 2006 from 10:00am to 2:00pm in front of Village Hall.
E. Resolution Scheduling an Executive Session Motion made by Trustee DiChiara and seconded by Trustee Griffin, Jr. scheduling an Executive Session following the Regular Meeting this evening to discuss pending litigation, personnel matters, and Real Estate matters, all in favor. 5) Mayor's Reports Trustee Griffin, Jr. advised that the Building & Grounds Committee held their monthly meeting prior to the Board Meeting. Mr. Griffin, Jr. advised that Assistant Village Manager, Jeff Econom, presented to the Committee many of the issues that he has been working on to include the Clock Tower at Village Hall, Leonard Park wall failure, Independence Fire House, wiring issues at Village Hall and OSHA issues at the Highway Department facility. Trustee Griffin, Jr. said that the Committee will be bringing additional recommendations to both Jim Palmer and Jeff.
Trustee Grunthal advised that the Finance Committee met last week and discussed long term capital budgeting and replacement of Village vehicles. Trustee Grunthal said that there is a lot of information out there as to what other municipalities are doing and what accounting standards say about the appropriate replacement time for vehicles.
Trustee DiChiara advised that he has been working with Village Manager, James Palmer, on better ways that Mount Kisco can enforce the Building and Zoning Codes. Trustee DiChiara said that he is hoping to have some proposals before the Board within the next couple of months.
Mayor Cindrich commented on the Barghout petition for annexation from the Town of Bedford into the Village of Mount Kisco. Mayor Cindrich advised that the property is located on and off Turner Lane which is in the Northwest corner of Mount Kisco. Mayor Cindrich advised that Mount Kisco and the Town of Bedford held a joint public hearing to discuss this petition and they are anticipating a decision relatively soon. Mayor Cindrich advised that he attended a seminar sponsored by the Federal Highway Administration that focused on improvement of traffic movement that addressed new techniques in increasing pedestrian safety, implementation of traffic calming counter measurers and the improvement of road design and intersections. Mayor Cindrich said that he has been working closely with the New York Department of Transportation and the County to make certain improvements. Mayor Cindrich said that he had the opportunity to discuss Hillside Avenue with project engineers who were in attendance at the seminar. Mayor Cindrich said that some of the suggestions from his discussions with the DOT were to place "Do Not Enter" signs at the top of Hillside Avenue and painting a white line on the north side of Hillside Avenue which would focus on the reduction of width of the roadway and provide in certain areas a demarcation point for pedestrian traffic. Mayor Cindrich said that he will discuss this further with the Police Chief. Mayor Cindrich advised that Pine Crest Manor is under new ownership/management and he is continuing to work with that group to perfect an operating procedure for a number of problems the residents have which will include maintenance schedules to work towards making it a better place to live. Mayor Cindrich asked Village Manager, James Palmer, to work with Assistant Manger, Jeff Econom regarding the Mount Pleasant Library to create a solution to some of the problems with respect to moving books from the Maple Avenue Community Center. Mayor Cindrich suggested that an inventory be started with respect to parking on Maple Avenue in the event that we relocate a temporary library. Mayor Cindrich also asked that the other recommendations and requests be complied with regarding exterior lighting and other needs to make the building safe. Mayor Cindrich stated that he has been advised that electric power purchased from the New Power Authority will be going up by 17% in 2007. Mayor Cindrich advised that on Sunday, October 15, 2006 the Italian American Club will host a brief ceremony at 11:00am at the Christopher Columbus Statue recognizing the achievements of Christopher, on October 15, 2006 the Mount Kisco Lions Club at the American Legion Post will hold their Annual Gourmet Brunch and on October 29, 2006 the Italian American Club will hold a dinner dance recognizing several members of our community.

Resolution Authorizing the Village Manager to Sign the IMA with Westchester County for Refuse Disposal Motion made by Trustee DiChiara and seconded by Trustee Grunthal authorizing the Village Manager to sigh the Intermunicipal Agreement with Westchester County for disposal of refuse and solid waste, all in favor. Resolution Adopting Parking Permit Rates for 2007 Motion made by Trustee Grunthal and seconded by Trustee DiChiara approving charging parking permit holders an additional $25.00 to add a second vehicle to the hang tag permit, all in favor. D. Resolution Authorizing the Village Manager to Retain Harbridge and Company for Actuarial Services with respect to GASB 45. Motion made by Mayor Cindrich and seconded by Trustee Grunthal authorizing the Village Manager to retain Harbridge and Company to perform Actuarial Services with respect to GASB 45 requiring all Municipalities in the State of New York to account for Post-Employment Retirement Benefits with respect to Health Benefits, all in favor. E. Resolution Scheduling a Public Hearing Re: Proposed Franchise Agreement from Verizon for Cable Services. Motion made by Mayor Cindrich and seconded by Trustee DiChiara scheduling a Public Hearing for Monday, October 23, 2006, 7:30pm, to hear comments with respect to a Franchise Agreement from Verizon for Cable Services, all in favor. F. Resolution Authorizing the Mayor to Sign the Stipulation Agreement with Robert Dagostino Motion to table resolution was made by Mayor Cindrich and seconded by Trustee DiChiara, all in favor.
8) Bills - The following motion was offered by Trustee DiChiara and seconded by Trustee Grunthal to pay the bills but to hold payments to Westchester Community College until further disclosure of what the payments are for, all in favor.

10) Non-Local Business - None
11) Public Comment - Terry McCormack, 41 North Moger, Unit 3, Mount Kisco, New York, addressed the Board regarding quality of life issues. Mr. McCormack highlighted some issues regarding improved lighting that has still not been addressed, lack of ticketing of cars parked illegally on North Moger, the need to remove graffiti, additional trash cans at bus stops, and the overall disrespect of youth in this area. Mr. McCormack asked that the Village increase bike and foot patrol in this area to help resolve some of the issues. Mr. McCormack also requested that "No-Bike Riding on Sidewalks" be enforced. Mr. McCormack said that this is very dangerous and should not occur on the busy sidewalks of our community.
Mayor Cindrich said that in the past the Board has held a community-walk with residents in certain areas. Mayor Cindrich said that he will schedule one for this area. Mayor Cindrich said that unfortunately the Police Officer that heads the bike patrol is currently out on injury. Mayor Cindrich said that parking enforcement out of the downtown area is a significant problem and is an issue that this Board has been addressing with the Police Department with an effort to increase patrol to resolve these issues.
There being no further business to come before the Board a motion to close the meeting was made by Trustee DiChiara and seconded by Trustee Griffin, Jr., all in favor. 9:40pm.
