Village Board Meeting Minutes - April 23, 2008

Minutes of a Special Meeting of the Board of Trustees of the Village/Town of Mt. Kisco held on April 23, 2008, at 8:30 p.m. in Village Hall, 104 Main Street, Mount Kisco, New York.

Whitney Singleton, Village Attorney

Mayor Cindrich convened the Special Meeting. Mayor Cindrich stated that there were two items on the agenda for the Village Board to consider: 1.) Authorization for the Village Attorney to enter into a release agreement and execute a stipulation of settlement in the matter of Croton Point Landfill Joint Defense Group v. Kraft Foods North America, et al; 2.) Adoption of the 2008-2009 Budget.

Resolution authorizing the Village Attorney to enter into a release agreement and stipulation of settlement concerning the Croton Point Landfill litigation.

Whitney Singleton explained that upon execution of the release and stipulation of settlement the Village would issue a payment of $10,290.00 to Periconi, LLC. The stipulation of settlement would release the Village from any and all claims that the Plaintiffs, their successors and assigns may have or could have asserted against the Village in any contribution action related to the Croton Point Landfill.

The following motion was offered by Trustee Markus and seconded by Trustee Grunthal, all in favor to authorize the Village Attorney to enter into a release agreement and stipulation of settlement in the matter of Croton Point Landfill Joint Defense Group v. Kraft Foods North America, et al.

Resolution for adoption of the Budget for Fiscal Year June 1, 2008 through May 31, 2009.

The following motion was offered by Deputy Mayor DiChiara and seconded by Trustee Markus.

Resolved, that the Preliminary Budget for fiscal year June 1, 2008 through May 31, 2009 is hereby modified by the changes listed on the attached schedule and be it further

Resolved, that the Preliminary Budget, as amended by the attached changes, shall constitute the Adopted Budget for the Village/Town of Mount Kisco for the fiscal year June 1, 2008 through May 31, 2009, and be it further

Resolved, the FY 2008/2009 Adopted Budget shall include the appropriation of $65,000 from the Village's Contingency and Tax Stabilization Reserve Fund as authorized by Section 6-e of the General Municipal Law, and be it further

Resolved, that the Board of Trustees shall levy a property tax of $13,139,933 (tax rate $83.2959 per $1,000 assessed valuation) on the applicable real property in the Village of Mount Kisco, and shall levy a special assessment property tax of $174,967 on the applicable real property tax covered by such areas.
