Donald Rose: Good evening. We will call to order the September 18, 2007 meeting of the Zoning Board of Appeals. We will note for the record that there are no members of the public in attendance.

Final Action:

Mount Kisco Commons

Donald Rose: It's listed as Final Action. I don't think there is anything we need to do. Counsel, on the question of Mount Kisco Commons; the application is formally withdrawn.

Karen Schleimer: I think just to acknowledge the receipt of the letter from Shamberg Marwell will be sufficient.

Donald Rose: That will be the way we will note it. There was a letter sent by facsimile and first class mail dated September 14, 2007, formally advising the board that Mount Kisco Unit One, LLC, Mount Kisco Owner LLC and Bazaar Mall Associates v. the Zoning Board of Appeals of the Village/Town of Mount Kisco has become moot, if I'm using that correctly, because they have formally withdrawn their application. There is no further work to be done by this board.

We have three final resolutions that call for approval by the board, at which point they can be signed and become part of the record.
